New Regulation (EU) 2026/405 on detergents and surfactants
On 2 March 2026, the new Regulation (EU) 2026/405 on detergents and surfactants was published, replacing the existing Regulation (EC) 648/2004.
It is a new, comprehensive regulatory system for the entire category of detergents and surfactants placed on the market within the EU.

The regulation will enter into force on 22 March 2026 and will apply from 23 September 2029.

The following transitional periods apply:
Detergents and surfactants placed on the market before 23 September 2029 that comply with the old Detergents Regulation (EC) No 648/2004 may continue to be made available on the market without a time limit.
Detergents and surfactants which were placed on the market after 22 September 2029 and before 23 September 2030 and which comply with Regulation (EC) No 648/2004 as amended on 22 September 2029 may be made available on the market until 23 September 2030.

Importers shall provide the ingredient data sheet before placing detergents or surfactants on the market for end-users and update the ingredient data sheet if necessary
Include their name, registered trade name or registered trademark, postal and email addresses, and telephone number where they can be contacted on the label.
Obligations of distributors:
The distributor shall provide the ingredient data sheet before the product is made available on the market and, if necessary, update the ingredient data sheet, unless they can demonstrate that the same information has already been provided to the designated body by another economic operator.
When are importers and distributors subject to manufacturers’ obligations?
- where the importer or distributor places the detergent or surfactant on the market under his own name or trade mark
- in such a way that compliance with this Regulation could be affected.
- make a surfactant that is not a surfactant intended for end-users available to end-users.
If an importer or distributor packages/repackages a detergent or surfactant, it has the following obligations:
They shall ensure that the name, registered trade name or registered trade mark, postal and electronic address and telephone number of the importer or distributor appear on the packaging and that the information is preceded by the words ‘Packaged:’ or ‘Repackaged:’
General labelling requirements
Detergents and surfactants made available on the market in individual packaging or through refilling must be accompanied by a label.
An economic operator who makes a detergent or surfactant available on the market directly to the end-user through refilling shall provide the end-user with a physical label and data carrier and shall ensure that the physical label and data carrier are available for each packaging that is refilled with detergent or surfactant.
The information on the label shall be available in the language or languages required by the Member State in which the detergent or surfactant intended for end-users is made available on the market.
Information on the label
- the type number, batch number or other element enabling the traceability of the product;
- the unique formulation identifier for the detergent or surfactant intended for end-users, preceded by the initial acronym ‘UFI’ in capital letters followed by a colon (‘UFI:’);
- the name of the manufacturer and, where applicable, the name of the importer, their registered trade name or registered trade mark, and the postal and email address and telephone number at which they can be contacted; the postal address indicates one specific location in the Union;
- the name and trade name of the product;
- instructions for use and special precautions, if necessary and relevant;
- where applicable, an indication that the product is an industrial and institutional detergent for professional use only;
- in the case of surfactants, an indication that the product is suitable for use in detergents;
- detergent or surfactant content in accordance with these rules
Labels for consumer detergents, automatic detergents and surface cleaners shall include dosage instructions as required by Part B of Annex V.
Forms of labeling
The information shall be provided:
- on the physical label, or
- on the digital label and with duplication on the physical label
An exception applies to the information listed in Part C of Annex V, which may only be provided in digital form. Some information, such as traceability elements, such as type number, batch number, manufacturer’s name and, where relevant, importer’s name, registered trade mark or trade mark, email address, telephone number, postal address indicating one location in the Union, and the name of the product and trade name, it is sufficient to indicate only on the physical label.
For detergents and surfactants sold at a distance, the online offer shall clearly and visibly indicate the labelling information required under Article 17, together with a digital version of the data carrier or a unique product identifier.
In the case of consumer laundry detergents, it is sufficient to provide dosage information in accordance with points 1 and 2 of Part B on a digital label only if a simplified dosage table is provided on the physical label.
Digital Labeling
Digital Labeling Requirements
1.Where detergents and surfactants are labelled with a digital label in accordance with Article 18, the following rules shall apply to that label:
- all labelled information listed in Part A of Annex V and, where applicable, in Part B of that Annex shall be provided jointly in one place and separately from the other information;
- the information on the digital label can be searched;
- the information on the digital label shall be accessible to all users in the Union;
- the information on the digital label shall be accessible through the data carrier referred to in Article 21(2)(h);
- the information on the digital label shall be presented in a format that also takes into account the needs of vulnerable groups, including persons with disabilities, and, where relevant, shall be adapted to enable and facilitate access to information for those groups;
- The digital label is accessible through commonly used technologies and compatible with all major operating systems and browsers
- the digital label shall be available for a period of ten years from the date of placing the detergent or surfactant on the market, including in the event of the insolvency, liquidation or cessation of the activity of the economic operator that created it in the Union, or for a longer period in accordance with the requirements of other Union law applicable to the information contained on the label;
- Where the information on the digital label is available in more than one language, the choice of language should not depend on the geographical location of the end-user from which he or she can access that label.
Digital Product Passport
Before placing a detergent or surfactant intended for end users on the market, the manufacturer shall create a digital product passport for that product.
Digital Product Passport:
- corresponds to a specific model of detergent or surfactant intended for end-users;
- indicates that the conformity of the detergent or surfactant intended for end-users with this Regulation has been demonstrated;
- contain at least the particulars set out in Part A of Annex VI;
- it is accurate, complete and current;
- it is available in the language or languages required by the Member State in which the detergent or surfactant intended for end-users is made available on the market;
- it is accessible to consumers or other end-users, market surveillance authorities, customs authorities;
- it is available for a period of ten years from the date on which the detergent or surfactant intended for end-users is placed on the market, including in the event of insolvency, liquidation or cessation of the activities of the economic operator that created the digital product passport in the Union;
- it shall be connected to the persistent unique product identifier by means of a data carrier;
Register of digital product passports
Before placing a detergent or surfactant intended for end-users on the market, the relevant economic operator shall enter in the register established pursuant to Article 13(1) of Regulation (EU) 2024/1781 a unique product identifier and a unique entity identifier related to the detergent or surfactant intended for the end user.
The Commission shall establish a digital register by 19 July 2026.
Biodegradability:
Surfactants and surfactants contained in detergents shall comply with the biodegradability requirements set out in Part A of Annex I.
- Surfactants and surfactants contained in detergents shall be biodegradable as determined in accordance with the criteria set out in point 2.
- Surfactants and surfactants contained in detergents shall be considered to achieve final aerobic biodegradation if they meet one of the following criteria:
- the level of biodegradability (mineralization) reaches at least 60% within 28 days
- the level of biodegradability (mineralization) reaches at least 70% within 28 days
For each of the criteria, the types of approved test methods are specified, Annex I, paragraph 2
Detergents containing microorganisms
Detergents containing micro-organisms must comply with the requirements set out in Annex II
Restrictions on phosphates and other phosphorus compounds
Detergents listed in Annex III shall comply with the restrictions on phosphates and other phosphorus compounds set out in that Annex.
By 23 March 2033, the Commission shall submit a report to the European Parliament and to the Council:
- as regards detergents containing micro-organisms, the appropriateness of the requirements set out in Annex II to ensure the safety of those products for human health and the environment
- for detergents containing phosphates and other phosphorus compounds, the possibility to further limit the phosphorus content or to add phosphorus restrictions in other product categories to Annex III in order to explore the feasibility of phasing out phosphorus, taking into account the environmental impact, the availability of alternatives and the socio-economic impact of substitution
