BIODEGRADABILITY REQUIREMENTS

Detergents and surfactants shall comply with the biodegradability requirements set out in Annex I. 
Exemption from biodegradability requirements: 
  • Surfactants which are active substances within the meaning of Regulation (EC) No 528/2012, and which are used as disinfectants, if they meet any of the following conditions: 

                  -surfactants included in the list of approved active substances   

                  -the surfactants are included in the review programme  

  • surfactants which are ingredients of biocidal products authorised in accordance with Regulation No 528/2012 

  • surfactants which are constituents of biocidal products, and which may be made available on the market under transitional provisions in accordance with Regulation No 528/2012 

Detergents containing micro-organisms shall comply with the requirements set out in Annex II to this Regulation. 

Detergents listed in Annex III to this Regulation shall comply with the restrictions on phosphates and other phosphorous compounds set out in that Annex. 

 

DETERGENTS AND SURFACTANTS PRESENTING A RISK TO HEALTH OR THE ENVIRONMENT 

If, after carrying out an evaluation, the Authority finds that a detergent or surfactant, although compliant with this Regulation, presents a risk to health or the environment, it shall require the manufacturer/supplier/distributor to take all appropriate measures to minimise the risk, failing which it shall be obliged to withdraw the product from the market.
