1.    22nd and 23rd ATP to CLP

The mandatory application deadlines for CLP amendments arising from ATP 22 (1 May 2026) and ATP 23 (1 February 2027) are approaching, requiring urgent action from chemical companies. Companies should analyse the impact of the new classifications on their products as soon as possible and update documentation, labels and regulatory notifications. Early preparation is key to ensuring compliance and avoiding operational and legal risks.

2.    Summary of upcoming CLP deadlines

  1. New hazard classes

Regulation (EU) 2023/707 introduces three new hazard classes that were previously not covered by the GHS system. These are. S system. These are ED substances,PBT / vPvB, PMT / vPvM. Implementation of the new CLP requirements is phased, however some deadlines have already passed or are imminent.

  • New labelling and communication obligations

Regulation (EU) 2024/2865 introduced additional changes taking effect from 1 July 2026. The next stages of the changes include: 1 January 2027 – extended mixture identifiers (including the obligation to indicate ED, PBT/vPvB and PMT/vPvM substances), and 1 January 2028 – new label formatting rules, requirements for advertising and online sales, as well as fuel labelling requirements.

  • New MOCS classification rules

From 1 July 2026, the principle applies that MOCS substances must be classified in the same way as mixtures – using calculation methods and a “worst-case” approach.

3. Fragrance allergen labelling in cosmetic products

From 31 July 2026, in accordance with EU Regulation 2023/1545, mandatory declaration of 56 additional fragrance allergens on cosmetic product labels enters into force. This deadline is not subject to postponement. Responsible Persons must ensure compliance of all product labels in circulation by that date or withdraw and re-label non-compliant products.

4. Microplastics reporting

Manufacturers and industrial downstream users of synthetic polymer microparticles (SPM) used as a raw material for plastics production were required to submit the first annual emissions report to ECHA by 31 May 2026 (covering 2025 emissions). Additionally, on 2 June 2026, an amendment to entry 78 of Annex XVII to the REACH Regulation (concerning synthetic polymer microparticles) was published.

5.    Empowering Consumers Directive

Since March 2026, the Directive on Empowering Consumers for the Green Transition has been in force. Vague environmental claims such as “climate neutral” or “environmentally friendly” are prohibited unless they are supported by verifiable evidence. Companies must also provide information on product durability and reparability.

6. Packaging and Packaging Waste Regulation (PPWR)

The general provisions of the Regulation enter into force in August 2026, harmonising packaging rules across the EU and aiming to reduce waste. Companies must:

  • Monitor the composition of packaging materials
  • Verify the origin of recycled materials
  • Prepare for substance restriction requirements in packaging materials

7.    Extension of UA REACH pre-registration

Ukraine has extended the UA REACH pre-registration deadline to 26 January 2027, providing an additional year for preparation. Despite the extension, completing pre-registration in 2026 is recommended due to potential administrative delays related to the geopolitical context.

8. EUDR and DWD

  1. EU Deforestation Regulation (EUDR)

From 30 December 2026, medium and large companies must meet strict traceability requirements for commodities such as coffee, cocoa, soy, palm oil, cattle, wood, rubber and derived products. Companies must demonstrate that their products have not contributed to deforestation or forest degradation after 31 December 2020.

  • Drinking Water Contact Materials (DWD)

New hygiene standards for materials in contact with drinking water (pipes, seals, pumps, etc.) enter into force on 31 December 2026.

9. New chemicals enforcement project REF-16

ECHA has announced a new EU-wide enforcement project. Inspections will focus primarily on verifying that prohibited or restricted substances do not exceed the permitted limits in products and mixtures. A new feature of the project is the inclusion of products sold online, as non-compliant products have frequently been identified through online sales channels in the past. Inspections are expected to begin in 2028.

10. New Detergents and Surfactants Regulation

On 2 March 2026, Regulation (EU) 2026/405 on detergents and surfactants, replacing the previous Regulation (EC) 648/2004, was published in the Official Journal of the EU. It entered into force on 22 March 2026 and will apply from 23 September 2029. Transitional periods allow continued sale of products compliant with the old regulation within specified timeframes.
