How will CLP affect the SDS?

In December 2022 came into force a new Comission Delegated Regulation (EU) amending Regulation EC No. 1272/2008 as regards hazard classes and criteria for the classification, labeling and packaging of substances and mixtures, called CLP (Classification, Packaging and Labelling).

CLP uses the terminology, assessment principles and criteria of the Globally Harmonized System (GHS).

Key aspects of the new EU CLP regulations:

  • Endocrine disruptors (EDs) for human health and the environment
  • PBT and vPvB substances
  • PMT and vPvM substances

These categories have specific concentration limits for the classification of mixtures, ensuring regulatory precision. For example:

Endocrine disruptors for health and the environment: Category 1 substances ≥0.1%, and Category 2 substances ≥1%;
PBT/vPvB and PMT/vPvM: Classified when a component is present in a mixture at 0.1% or more.

Concentration limits and compliance deadlines

The deadline for classification of new substances is 1 May 2025 and for mixtures this deadline can be extended until 1 May 2026. TotalSDS continues to provide guided documents to support customers step by step.

The entry into force of CLP required an update of Annex II to the REACH Regulation, which describes all the conditions for the development of an SDS. These changes are contained in the EU Commission Regulations, which are: Regulation (EC) No 453/2010 of the European Parliament and of the Council of 20 May 2010 amending Regulation (EC) No 1907/2006 on the Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH).
