Labelling and packaging under EU CLP Regulation

Once the hazardous properties of a substance or mixture have been identified, they need to be classified accordingly.

Manufacturers, importers, downstream users and distributors, as well as producers and importers of certain specific articles, must communicate the identified hazards to the other actors in the supply chain, including to consumers.

This is done by labelling the substance or mixture in accordance with CLP before placing it on the market, when:

  • The substance or mixture is classified as hazardous.
  • The mixture contains one or more substances classified as hazardous above a certain threshold.
  • The article has explosive properties.

the CLP regulation update introduces provisions for digital labeling:

  • Optional digital-only elements: Certain label elements, such as supplemental information referred to in Article 25(3), may be provided in digital form only.

  • Accessibility requirements:

    • Free access without registration or app installation.

    • Accessible for at least 10 years.

    • Compatible with all major operating systems and browsers.

    • Accessible with no more than two clicks.

  • Data protection: Prohibited tracking or analysis of usage information beyond what’s necessary for digital labeling.

Label Update – defined

  1. If the classification or labeling of a substance or mixture changes, resulting in the addition of new hazard categories or a more severe classification, or if additional information is required on the label, the supplier of the substance or mixture must ensure that the label is updated promptly, and in any case, no later than 6 months after the supplier receives the new assessment results.
  2. If any other changes occur to the classification or labeling of a substance or mixture, the supplier should not unduly delay and must complete the label update as soon as possible, and in any case, no later than 18 months after the supplier receives the new assessment results.
  3. If the classification or labeling update of a substance or mixture is due to the harmonized classification, it should adhere to the effective date specified in the ATP (Adaptation to Technical Progress), which is typically 18 months after these provisions come into effect.
