ONLINE SALE AND ADVERTISEMENT OF CHEMICALS

Chemical mixtures and products classified as hazardous must meet a new requirements for online sales, as well as meet information requirements when advertising products. The new requirements result from the updated CLP regulation, which aims to improve the safety of users and consumers, as well as to adapt to technological progress and changing forms of product sales.

Every manufacturer, distributor and seller must pay special attention to the content of the chemical product announcement and its advertising and marketing materials.

ADVERTISEMENT – article 48 of CLP Regulation

Each advertisement for a substance or mixture classified as hazardous should include:

It should be focused that advertising can be carried out using various channels of information flow. Therefore, each form of advertising: press, online, mobile, or advertising in public spaces will have to contain the above-mentioned elements for a product classified as dangerous. Also brochures, catalogues and marketing materials that are part of the product advertising will be subject to the above requirements.

Entities placing hazardous substances and mixtures through online sales must provide the label elements listed in Article 17 of the CLP Regulation:

This can be done either by adding a clear and legible photo of part of the product label, or by including the necessary information in the advertisement and product description.

Planned inspections:

In 2025, inspections are planned as a part of the REACH-EN-FORCE (REF)-13 project. Their aim will be to check whether chemicals sold online comply with REACH restrictions, and whether mixture labels and their online offers contain appropriate information on the hazard and risk posed by the product.
