CLP

On 10 May 2024, the Technical Regulation “On Classification, Labelling and Packaging of Chemical Products” (UA CLP) was approved, which will enter into force on 15 November 2024, six months after approval. Like its European counterpart, the Ukrainian CLP regulation requires the notification of the classification and labelling of hazardous substances that enter the Ukrainian market, regardless of their annual tonnage.

To meet the requirements of Ukrainian CLP, information on the classification of a substance must be submitted to the Ministry of Environmental Protection and Natural Resources of Ukraine (MEPR) in Ukrainian through a Ukrainian entity. For substances that were on the Ukrainian market before the entry into force of the UA CLP, i.e. before 15 November 2024, a one-year transition period applies, which means that the CLP notification must be completed by 15 November 2025. For substances that enter the Ukrainian market for the first time after the entry into force of the UA CLP, the CLP notification must be completed within 30 days from the date of first placing on the market.

Main requirements

Under Ukraine’s CLP Regulation, all manufacturers, importers and distributors of chemicals in Ukraine are required to classify, label and package substances and mixtures according to their hazardous properties. This means that businesses must assess the risks associated with their products, including physical, health and environmental risks, and provide clear and standardised labelling. Hazardous chemicals must include symbols, signal words (e.g., “Danger” or “Warning”), and safety warnings to inform users of safe handling and potential hazards.

Obligations of entrepreneurs

Businesses in Ukraine that handle hazardous chemicals will have to comply with a number of obligations:

Self-classification: Companies must assess their products and classify them based on established hazard criteria.

Labelling: Labels must comply with standardised formatting, including specific pictograms, hazard and safety warnings.

Packaging: Safe packaging to prevent accidental exposure is mandatory, with additional child caps if necessary.

Impact and benefits

In Ukraine, CLP is expected to raise safety standards for chemicals and provide consumers and workers with essential information to reduce the risks associated with the handling of hazardous substances. This regulation will not only bring Ukraine into line with EU standards, but will also help businesses prepare for potential exports to the EU by ensuring compliance with international requirements.

By adopting CLP standards, Ukraine is reinforcing its commitment to public safety, environmental health and responsible management of chemicals. This change means aligning Ukraine with the EU’s sustainable and safe approach to chemicals regulation.
