Article 95 of the Biocidal Products Regulation (EU) No 528/2012 (BPR)

Article 95 of the Biocidal Products Regulation (EU) No 528/2012 (BPR) aims to ensure the equal treatment of persons placing active substances on the market and to establish a level playing field as quickly as possible on the market for existing active substances. To achieve this, the European Chemicals Agency (ECHA) publishes a list of relevant active substances and suppliers (substance and product).

Restrictions from September 1, 2015

Starting September 1, 2015, a BP cannot be accessible on the EU market if the substance supplier or product supplier is absent from the Article 95 list corresponding to the product-type (PT).

Obligations under Article 95

Article 95 imposes a duty on those offering BPs on the market. Additionally, they must confirm inclusion of “substance supplier” or “product supplier” listed by ECHA under Article 95 for the relevant PT. Moreover, “alternative suppliers” need to submit to ECHA for list inclusion.

Supply Chain Compliance

Not all companies necessitate inclusion in the Article 95 list. The presence of a single listed company within the supply chain suffices. The Article 95 list is organized according to active substances.

Information in the Article 95 List

The list includes supplier names (with countries), roles as “substance” and/or “product” supplier, relevant PT, inclusion date, and indicated objects.
