A new law on chemical safety and management of chemical products will enter into force in Ukraine on November 2, 2024. Under this legislation, biocides are classified as products subject to specific requirements, but are mainly excluded from the registration requirement under the general procedure for other chemicals.
On the manufacture on the market and use of biocidal product
Nevertheless, biocides must meet the requirements for classification, labelling and safety data sheets, especially in the context of the Globally Harmonized Classification System (GHS), which is part of the legislation. This means that companies that produce or import biocides must comply with these standards to ensure the safety of their use in the Ukrainian market.
Key aspects of biocides registration
Registration of biocidal products:
All manufacturers, importers and distributors of biocidal products are required to register their products before placing them on the Ukrainian market.
The application for registration must contain detailed information on the product’s composition, efficacy, safety and potential risks.
Risk assessment:
Authorised biocides undergo a thorough risk assessment to assess their impact on human health and the environment.
The assessment shall take into account toxicity, persistence in the environment and effects on non-target organisms. Depending on the results, additional precautions may be necessary.
Authorisation for hazardous substances:
Biocidal products containing high-risk substances (e.g. carcinogens or mutagens) require specific authorisation before use.
This ensures that highly hazardous substances are controlled and used only when absolutely necessary.
Supply Chain Information:
Suppliers must provide consumers with detailed information on the safe use of biocidal products.
Users should be informed of all the risks involved and the necessary safety measures.
The new regulation on biocidal products increases safety on the Ukrainian market by protecting public health and the environment. In addition, it aligns Ukrainian standards with international requirements, making it easier for Ukrainian products to enter European markets. This alignment supports Ukraine’s commitment to the responsible management of chemicals and sustainable development.
